Where the Turkish citizen spouse dies while an Article 16 citizenship application is pending, the requirement to be living together in family union is no longer sought and the application continues on its remaining conditions. The citizenship application

Article 16's family-union condition presupposes a living spouse. Where the Turkish spouse dies after the application has been filed, that condition is no longer sought, and the file proceeds on the remaining requirements — three years of marriage, no conduct incompatible with the marriage union, and no national-security or public-order obstacle. This is one of the few places in Turkish nationality law that operates in the applicant's favour without argument.

What still has to be shown is that the marriage was real and that the couple were living together before the death. The evidential exercise is the same one described in the genuineness assessment, with the added difficulty that one of the two people who could speak to it is gone. Where a spouse is ill, this is an argument for assembling the record early rather than at the interview.

The residence permit

Here the logic runs the other way. A family residence permit is granted on the strength of a family relationship with a sponsor. When the sponsor dies, the factual basis of the permit changes, and the surviving spouse should not assume the card simply runs to its printed expiry without consequence. Take advice promptly on whether to seek a variation, a different category, or — where the qualifying time is there — to proceed to naturalisation under Article 11 on the strength of the residence already accumulated.

Inheritance

The surviving spouse is a statutory heir under the Turkish Civil Code, taking a share alongside the deceased's descendants, parents or grandparents depending on which class survives. Foreign nationals may inherit in Türkiye, including real property, subject to the reciprocity framework and to the restrictions on foreign ownership in certain zones.

Two practical points. Turkish estates require a certificate of inheritance (veraset ilamı) before anything can be transferred, and a tax clearance before a title deed moves. And where the deceased held assets in more than one country, the applicable law question has to be answered before anything is distributed. Neither is difficult, but both take longer than families expect.

Children

Children of the marriage are Turkish citizens by descent from their Turkish parent, and the death does not change that — see children, descent and the marriage route. What to do, in order

  1. Register the death and obtain the updated population registration record.
  2. Notify the pending citizenship file through the provincial directorate, with the death certificate.
  3. Review the residence position before any deadline arrives — permit expiry, renewal window, insurance cover.
  4. Open the estate: certificate of inheritance, then tax clearance, then transfers.
  5. Deal with the children's position if you intend to travel or relocate.
